WARRANTY ACTIVATION
Begins from shipment of the machine from Robopac USA. In case of container program, warranty for each machine will begin from date of shipment for dealer warehouse. A photograph or scanned copy of the Warranty Activation Document MUST be emailed to sale@daybreakmachine.com within 10 business days of the completion of the equipment installation.
Robopac USA warrants that hardware and parts delivered under this Agreement shall be free of defects in material and workmanship.
The warranty period for each hardware and part shall be as follows:
Robopac Semi-automatics
5 Years: Masterplat, Rotoplat 708
3 Years: Ecoplat, Technoplat 708 CS/CW
1 Year: Robot S7, Masterwrap HD XL, Rotary, Rototech 708 CS/CW, Compacta Series, Orbit Series, and Spiror Series. Extended warranty available.
Robopac Automatic Stretch Wrappers – Warranty period is 14 months from shipping date from the factory. Extended warranty available.
Prasmatic, DIMAC, and Sotemapack case packers – Warranty period is 14 months from shipping date from the factory. Extended warranty available.
Robopac USA receives written notice of such defects during the warranty period, Aetna Robopac USA will, at its option, either repair or replace the hardware or part that proves to be defective. Equipment and accessories not of Aetna’s (Robopac USA) manufacture are warranted only to the extent that they are warranted by the manufacturer(s) of the same.
Robopac USA liability or warranty shall not exceed the amount of the purchase price. There are no other warranties, express or implied, either of merchantability or of fitness for a particular purpose. The buyer agrees that there have been no representations upon which it has relied on other than those set forth herein. The buyer agrees that no liability for any special, indirect, or consequential damages of any nature is assumed by or shall be imposed on Aetna (Robopac USA) based upon its undertakings in this agreement.
DURATION AND COMMENCEMENT OF WARRANTY PERIOD – AUTOMATIC MACHINES
Warranty period is 14 months from shipping date from the factory. Extended warranty available. If Buyer schedules or delays installation more than thirty (30) days after delivery, the warranty period will be invalidated.
LIMITATION OF WARRANTY
Robopac USA’s warranty shall not apply to defects resulting from:
Improper or inadequate maintenance by Buyer.
- Buyer-supplied equipment and
- Buyer’s misuse, negligence, alteration, tampering or incorrect use of Robopac USA’s product.
- Damage incurred during shipment or unauthorized unpacking; or
- Damage resulting from Buyer’s incorrect implementation of Robopac USA advice in the installation, operation, maintenance, and use of the
Buyer agrees to defend, indemnify, and hold Robopac USA harmless, its subsidiaries and affiliates, and their respective directors, officers, employees, and agents (collectively referred to in this section as “Robopac USA”) from and against any and all actions, claims, and proceedings filed against Robopac USA that result from (a) Buyer’s improper or inadequate maintenance of the Product, (b) equipment and accessories supplied by Buyer, (c) Buyer’s misuse, negligence, alteration, tampering or incorrect use of Robopac USA Product, (d) Buyer’s unauthorized unpacking, or (e) Buyer’s incorrect implementation of Robopac USA advice in the installation, operation, maintenance and use of the Product.
SPARE PARTS
For sixty (60) days from the date of delivery of a spare part, Aetna will either repair or replace, at Aetna’s sole option, the part found defective due to faulty workmanship or materials.
Robopac USA’s limited warranty and its obligations and liabilities are in lieu of, and buyer hereby waives, all implied guarantees and warranties, including, without limitation, any warranty of merchantability of fitness for a particular purpose and it is in lieu of any liability of Robopac USA under any other provision. The buyer agrees that in no event shall Robopac USA be liable for loss of profits, special, incidental, or consequential damages arising out of any breach of obligation of this agreement. Damages are capped to the purchase price of the product. This limited warranty is given only to buyers and is not assignable.
Robopac USA warranties parts to be free from manufacturing defect for the prescribed warranty period. The Robopac USA warranty covers replacement parts. Each selling distributor is responsible for warranty service for equipment that they have sold. If warranty service labor is requested from Robopac USA, it will be billed to the distributor at Robopac USA’s published service rates. The warranty does not cover equipment that has been modified in any way from its original condition, intentional abuse or misuse, wear items, operation outside advertised specifications, accidental damage caused by customer negligence (such as collision damage caused by forklifts) or acts of God.
IMPROPER ASSEMBLY OR START-UP OF EQUIPMENT WILL VOID THE EQUIPMENT WARRANTY.
